Transfer Your Prop 13 Property Tax Base (Orange County, CA)

Living in Huntington Beach I come across quite a few people who have benefited from Prop 13. They purchased a home back in the 60’s or 70′s to raise their family in and now that their kids are grown and on their own they want something different. They may want to downsize into a smaller single story home, a house with a pool, a bigger kitchen, or whatever the reason may be. I often hear, “I would move but I don’t want to pay the higher taxes.” Well there is a solution, Prop 60 and Prop 90.

Prop. 60 was a constitutional amendment approved by the voters of California in 1986. It allows the transfer of an existing Proposition 13 base year value from a former residence to a replacement residence located within the same county, if certain conditions are met. This benefit is open to homeowners who are at least 55-years old and are able to meet all qualifying conditions.

For example: If you sell your home for $750,000 and your tax base is $1,000 (because of Prop 13), then you buy another home for $500,000, you can take that same $1,000 tax base with you. Even though the tax base should be $5,500.

Alameda,  El Dorado, Los Angeles, Orange, San Diego, San Mateo, Santa Clara, and Ventura. [Contra Costa, Inyo, Kern, Riverside, Modoc, Monterey, and Marin have dropped out of the Prop 90 program.]  El Dorado is new to the program, effective in 2010.

Before attempting to transfer your tax base to another county you should contact the local county assessor to discuss eligibility.
